How To Complete An Amicable Report

The declaration of the car accident to your insurer is essential for your compensation. The drafting of the amicable report is one of the possible steps.

What the amicable report used for

The first usefulness of the joint report is to allow, in the event of a road accident, your insurer to know the circumstances of the loss.

Place of occurrence, time, date, parties involved, all information concerning the accident is valuable and must appear in the report.

They allow the insurer to determine everyone’s responsibilities and to calculate their compensation as accurately as possible.

When should you complete it and send it to your insurer?

The joint report is drawn up during a traffic accident involving at least one third-party vehicle. You have 48 hours to complete it, but we advise you to complete this task immediately.

Why? The reasons for the accident and its circumstances are fresh in your mind.

In addition, you have the certainty that the third party or parties do not change their minds.

You have five working days to send the accident report to your insurer, attaching pictures of the accident, if applicable.

If your vehicle is equipped with an on -board camera, you can also submit the images to your insurance company.


What if no one is able to write it?

If you and/or the other people involved are unconscious and unable to complete the joint report, the firefighters or the police generally take over.

They draw up a report which is then sent to your insurer.

You have the right to demand the transmission of this document.

The compensation period is generally longer than if a report has been established. This can sometimes be counted in months.

No joint report for minor material damage

For simple skirmishes that only cause inexpensive property damage for the parties involved, it is sometimes wise not to write an accident report, especially if you are responsible.

This would affect your bonus-malus and increase your insurance premium.

For example, you have a reduction-addition coefficient (CRM) of 0.54 before the claim.

If you report the accident, your CRM would now be 0.67. A penalty that inevitably increases your insurance bill: from a few dozen to sometimes more than a hundred euros.

In this case, you can simply make arrangements with the other driver regarding the payment of repairs to the vehicle, without going through the “insurance” box.

In case of impossibility to sign an amicable report

Drivers involved in a disaster are not always cooperative. They can also have a version of the collision. In these cases, alternatives are possible.

Drivers disagree

In the event of discordant versions on the circumstances of the accident, the insurers will share the responsibility between the drivers.

If the disagreements are minor, it is preferable that the 2 drivers sign the observation part on the front and indicate their comments in the “observations” section on the back.

If the disagreement is total, try to have as many witnesses as possible and do not sign the report. You have no legal obligation to do so.

If the other driver  refuses to sign  or  leaves  without writing a report, fill in  a report yourself , trying to attach as much information and evidence as possible (with the contact details of the witnesses).

How to complete the report?

An amicable report must only be drawn up in a single copy. Each party keeps a sheet for its own use. The document, which exists in paper and digital versions, consists of 2 parts:

On the front, the “report” part is common. Once completed and signed by the drivers involved, it is no longer possible to add information.

On the back, the “observation” part is individual.

Everyone is free to add details, comments or qualify certain information indicated on the front part.

Elements to be completed on site

Fill in legibly with a ballpoint pen the front of the report on the scene of the accident.
